1. Acceptance of Terms

By accessing or using ModelPix.ai ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and ModelPix.ai.

2. Service Description

ModelPix.ai is an AI-powered content generation platform that provides access to video generation, image generation, face swaps, voice cloning, and related AI tools. The Service operates as an authorized reseller of A2E.ai technology, offering a curated interface to multiple cutting-edge AI models.

The specific features, models, and capabilities available through the Service may change over time as we add new tools and update existing ones.

3. User Accounts

To use most features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• Each person may maintain only one account. Duplicate accounts may be terminated.
• You must notify us immediately of any unauthorized use of your account.

4. Credits and Payments

ModelPix.ai uses a credit-based system. Credits are required to generate content, and different tools and settings consume different amounts of credits.

• Credits can be purchased through our payment processor, PayGate.to, which supports cryptocurrency (BTC, ETH, USDT, USDC, SOL) and card payments (Visa, Mastercard, Apple Pay, Google Pay).
• All credit purchases are final. Purchased credits are non-refundable.
• If an AI generation fails due to a platform error, the credits for that generation will be automatically refunded to your account balance.
• Credit prices and exchange rates are subject to change. Any changes will apply to future purchases only.

5. Content and Ownership

You retain ownership of the AI-generated content you create using the Service. You are free to use, modify, distribute, and commercialize your generated outputs.

You are solely responsible for any content you upload or provide as input to the Service, including images, videos, audio, and text prompts. You represent and warrant that you have all necessary rights to use any input content you provide.

ModelPix.ai does not claim ownership of your generated content but reserves the right to use anonymized, aggregated usage data to improve the Service.

6. Prohibited Use

You agree not to use the Service to:

• Generate, distribute, or store any content that is illegal under applicable law.
• Create any content depicting, involving, or exploiting minors in any way.
• Produce deepfakes or synthetic media intended for fraud, harassment, defamation, or deception.
• Infringe upon the copyrights, trademarks, or intellectual property rights of others.
• Harass, threaten, or harm any individual or group.
• Attempt to reverse-engineer, exploit, or circumvent the platform's security, rate limits, or credit system.
• Resell or sublicense access to the Service without written authorization.

Violation of these prohibitions may result in immediate account termination without refund.

7. Service Availability

ModelPix.ai is provided on a best-effort basis. We do not guarantee uninterrupted or error-free operation of the Service. We may perform scheduled or unscheduled maintenance that temporarily affects availability.

AI model availability depends on upstream providers and may change without notice. We will make reasonable efforts to communicate significant changes in advance.

8. Limitation of Liability

To the maximum extent permitted by applicable law, ModelPix.ai and its operators, affiliates, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you have paid to ModelPix.ai in the twelve (12) months preceding the claim.

9. Termination

We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms. Upon termination:

• Your access to the Service will be revoked immediately.
• Any remaining credits in your account will be forfeited.
• We may delete your account data in accordance with our Privacy Policy.

You may also delete your account at any time through your account settings.

10. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify users through the Service or via email. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
